City Commission Reinstates 287(g) Agreement
In a 4–2 vote on July 8, 2025, the Key West City Commission approved a new 287(g) agreement with federal immigration authorities. Unlike the prior version, which was invalidated due to procedural errors, the updated agreement was properly executed through the City Manager’s office, rather than unilaterally signed by Police Chief Sean Brandenburg. The move drew vocal opposition from many residents in attendance, who voiced concerns over federal overreach and the implications for Key West’s immigrant community. Supporters of the measure emphasized the importance of following correct legal protocol.
Legal Action Against the State Authorized
In a separate action, commissioners voted to authorize the City Attorney to file a declaratory judgment lawsuit challenging the constitutionality of Florida’s mandate requiring local governments to enter 287(g) agreements. The city may also opt to join South Miami’s existing litigation against Governor Ron DeSantis and Attorney General James Uthmeier. This marks a significant step in pushing back against what some local leaders view as unconstitutional state interference in municipal governance.
